Thank you for your interest in the lift trucks and other Products ("Products"), Parts ("Parts"), and Services ("Services") advertised on our Site (collectively, the "Offerings").
A Special Notice About Children
Children (under the age of 18) are not eligible to use the Site. In any event, children should not submit any PII to us. If you are under the age of 18, you may not use the Site or Offerings.
You may visit the home page and a few pages of the Site containing general information without telling us who you are or revealing any personal information about yourself. We may track the Internet domain address from which you visit the Site and analyze this data for trends and statistics.
When you use the Site or contact us, we may ask you to provide personal information about yourself, including but not limited to, your name, company, address, telephone number, email address, gender, and occupation. Whether or not you choose to provide the information we request is entirely up to you.
Collection and Use of Personal Information
When available, we automatically collect information about your computer configuration, such as your browser type, operating system, IP address or ISP domain name, and navigational and clickstream data that shows what pages are visited and how long various features are used. Once you are a registered user or provide PII, this information is linked to you personally.
If you believe that any of your PII is incorrect, or has been changed since your use of the Site, please send an email message to firstname.lastname@example.org explaining the correction or change and provide any relevant confirmation or reference number.
We use the foregoing information to provide you with information regarding Offerings, including Products, Parts, and Services, that may suit your particular interests, customize and personalize content to you, administer and run the Site, and comply with any requirements of law.
We may disclose your personal information if necessary to protect our legal rights or if the information relates to actual or threatened harmful conduct. Further, certain disclosures may be required by law or if we receive legal process.
The Site uses cookie technology to improve the quality of your experience. A cookie is a small file that contains information sent by a website that is saved on your hard disk by your computer’s browser. Cookies store information that a website may need in order to personalize your experience and gather website statistical data. Do We Share Your Information?
Except as stated herein, TMHU will not share, sell, or transfer your PII to any third party, except as stated in “Collection and Use of Personal Information”, without your prior consent. We will share your PII with our partners and with third-party independent contractors, possibly including third parties that reside in jurisdictions with less restrictive data laws than your own jurisdiction. This will be shared for purposes of: (1) approving and enabling your participation in the Offerings; (2) providing you with Products, Parts, and Service offers via email or postal mail; and (3) tracking information generated through the site. Our partners and third-party independent contractors are obligated contractually not to use or share your personal information for unauthorized purposes.
We may also share aggregate (i.e., not personally identifiable) information about you with our business partners and other third parties. In addition, we may access, index, and cache your website, or any portion thereof, including by automated means including Web spiders or crawlers.
Specific Policy for Information Submitted to Career Opportunities
The information under this heading will provide TMHU’s policy as to how it will use the information you submit through the Career Opportunities and Lift Your Career sections of the website.
All application information you submit to TMHU is collected in the United States. Application information may be shared with TMHU’s affiliates, subsidiaries or independent dealers for employment consideration purposes. This Policy is governed by United States law.
This Policy covers any application information you submit to the TMHU, not limited to: (1) name, address, email address, telephone number, or other contact information; (2) resume or CV, cover letter, previous work experience, education, transcripts, or other information you provide in connection with the application process; (3) type of employment sought, desired salary, willingness to relocate, or other job preferences; (4) how you heard about the position; (5) sensitive information (race/ethnic origin) if you choose to submit it as part of the applications process, and; (6) names and contact information for referrals.
It is your responsibility to obtain consent from references before providing their personal information to TMHU.
Submission of application information does not establish any obligation not listed in this Policy.
The application information you submit is used for the following purposes: (1) to assess your skills, qualifications and interests against career opportunities; (2) to verify your information and conduct reference checks; (3) to conduct background checks if you are offered a job; (4) to communicate with you and inform you of career opportunities; (5) to create and submit reports as required by law or regulation; (6) to improve our recruitment process; and (7) legal defense as necessary.
If you accept employment with TMHU, the information collected will become part of your employment record and will be used for employment purposes.
TMHU conducts criminal background checks on all employees once they have completed the application process and are offered a job. Employment is contingent upon the completion of a satisfactory background check. If something on your background check appears to be a reason you cannot be hired, we will notify you that we may conduct an individualized assessment to determine if the conviction links to the essential functions of the job in which you are applying for. If TMHU comes to the determination that the conviction could potentially impact the essential functions of the job, TMHU will not be able to offer you a position because of that information. We will also provide you with a copy of your criminal background check, and we will provide you with information on the process for correcting a criminal record.
You can choose what types of application information, if any, to submit. Submitting your application information is voluntary. However, if you choose not to submit your application information, our ability to consider you as a candidate may be limited. We will ask for your consent before we obtain additional information from third party agencies, and will, where required by law, notify you of the information received from those third parties.
Employees of TMHU, affiliated companies, subsidiary companies, and TMHU’s independent dealers may view the information listed above. TMHU takes appropriate technical, organizational, and legal steps to protect application information.
Application Information is retained in accordance with TMHU’s document retention policy, and in no event for any period longer than necessary for TMHU’s business purposes.
We may change this Policy from time to time. We will post any changes to the Policy on this page.
You may “opt out” of having your personal information shared for purposes of receiving product offers via email or postal mail, and from receiving product offers directly from us via email or postal mail, by simply clicking on the box stating “I Do Not Agree” provided in the Site. If you choose not to give us your personal information, you can still access the Site.
We contract with a third party to maintain and host the Site. Therefore, any information you submit, including PII, will be placed and stored on a computer server maintained by this third-party host. The third party has agreed to implement technology and security features and strict policy guidelines to safeguard the privacy of your personal information from unauthorized access or improper use.
We do not provide the technologies used to build the Site, and therefore neither recommend nor endorse the same. Any information regarding identified technologies, including their capabilities, limitations, and applications, should be sought directly from their manufacturers. We hereby disclaim any rights to trademarks, service marks, trade names, logos, copyrights, patents, domain names or other intellectual property interests of third parties.
